Welcome to BibleNOW (the "Service," "we," "our," or "us"), a Christian social media platform designed to foster fellowship, study, and community through the lens of faith. These Terms of Service ("Terms") govern your use of our website, mobile applications, and other online services (collectively referred to as the "Platform").

By accessing or using the Platform, you agree to comply with these Terms and our Privacy Policy. If you do not agree with these Terms, you must not use the Platform.

1. User Eligibility

You must be at least 13 years old (or the minimum age required by your country's laws) to use the Platform. If you are under the age of 18, you must have the consent of a parent or legal guardian to use the Service.

By using the Platform, you represent and warrant that you meet the eligibility requirements and have the legal capacity to enter into this Agreement.

2. User Accounts

• To use certain features, you must create an account. You agree to provide accurate, current, and complete information during the registration process.
• You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
• If you suspect any unauthorized use of your account, you must notify us immediately.

3. User Conduct

By using the Platform, you agree to the following:

• Respectful Communication: You will engage with others respectfully, in accordance with the Christian values of love, kindness, and understanding.
• Prohibited Content: You must not post, upload, or distribute content that is:
  • Offensive, hateful, or harmful
  • Harassing, threatening, or abusive
  • Pornographic, sexually explicit, or inappropriate
  • Violent, discriminatory, or promoting illegal activities

4. Content Ownership and License

Your Content: You retain ownership of the content you upload or post on the Platform, but by posting content, you grant BibleNow a non-exclusive, worldwide, royalty-free license to use, modify, distribute, and display your content as part of the service.

Platform Content: All content provided by the Platform, including but not limited to text, graphics, logos, images, and software, is the property of BibleNOW or its licensors and is protected by copyright laws.

5. Privacy and Data Collection

Your use of the Platform is governed by our Privacy Policy. By using the Service, you agree to the collection and use of information as outlined in that policy. We may collect and use your personal data for purposes such as authentication, improving our services, and ensuring a safe user experience.

6. User-Generated Content and Moderation

• We reserve the right to monitor and remove any user-generated content that violates these Terms or our community guidelines.
• We employ AI moderation tools to help flag inappropriate content, but users are also encouraged to report violations to help keep the community safe.

7. Payment and Subscriptions (If Applicable)

Subscription Plans: BibleNOW may offer paid subscription plans for premium features. Prices and features are outlined within the app or on our website.

Billing: You will be billed on a recurring basis as specified in your subscription plan. Payments and payouts are handled via Stripe Connect. Users may purchase subscriptions or donate using Stripe's secure checkout. Verified Creators receive payouts directly through Stripe Connect, subject to Stripe's Connected Account Agreement. BibleNOW does not hold or distribute Creator earnings directly.

Refunds: All subscription fees are non-refundable, except as required by applicable law.

8. Termination and Suspension

Suspension of Account: We may suspend or terminate your account if we believe you have violated these Terms or engaged in any unlawful activity.

Account Termination: You may terminate your account at any time. Upon termination, we may delete your data and content, unless otherwise required by law.

9. Disclaimers and Limitations of Liability

No Warranties: The Platform is provided "as is" and without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of Liability: In no event shall BibleNOW be liable for any damages, including but not limited to loss of data, business interruption, or personal injury, arising out of or related to your use of the Platform.

Platform Disclaimer: BibleNOW does not act as an employer or guarantor for any Creator or user. We are a technology platform that facilitates interactions, livestreams, and transactions between users. We are not responsible for the actions or content of any Creator.

10. Indemnification

You agree to indemnify and hold harmless BibleNOW, its officers, employees, agents, and affiliates from any claims, damages, losses, and expenses arising from your violation of these Terms or your use of the Platform.

11. Governing Law

These Terms are governed by the laws of the state or country where BibleNOW is based, without regard to its conflict of law principles.

12. Dispute Resolution

Arbitration: Any disputes or claims arising out of or related to these Terms shall be resolved through binding arbitration.

Venue: Arbitration will take place in a mutually agreed location or virtually.

13. Changes to Terms

BibleNOW reserves the right to modify these Terms at any time. You will be notified of any significant changes, and your continued use of the Platform after such changes constitutes your acceptance of the updated Terms.

15. Creator and Streamer Accounts

Creator Accounts

Verified creators and streamers ("Creators") on BibleNOW are independent users who may earn revenue through features such as livestream donations, paid events, or other in-app monetization.

Independent Contractor Status

Creators are independent contractors, not employees, agents, or representatives of BibleNOW. BibleNOW does not direct or control how, when, or where Creators produce content. Each Creator is solely responsible for complying with all applicable laws, including tax reporting, and for obtaining any required licenses or permissions for their content.

Payouts and Stripe Connect

Payouts are facilitated through Stripe Connect, a third-party payment processor. Creators must complete Stripe's onboarding process to receive funds. By connecting a Stripe account, you agree to be bound by the Stripe Connected Account Agreement.

BibleNOW does not store, control, or access Creator earnings. All funds flow directly from supporters to Creators through Stripe. BibleNOW may charge a platform fee or processing fee on transactions as disclosed in the app.

Tax Responsibility

Stripe may issue applicable tax forms (such as Form 1099-K) to qualifying Creators. BibleNOW does not withhold or remit taxes on behalf of Creators. It is each Creator's responsibility to report and pay taxes on income earned through the Platform.

Account Suspension or Removal

BibleNOW reserves the right to suspend or terminate a Creator's monetization privileges or Stripe connection for violations of these Terms, fraud, or other improper activity.
